Welcome to Brass Essence. These Terms of Service ("Terms") govern your access to and use of our website (https://brassessence.in) and the purchase of products offered by Brass Essence. By accessing our website, browsing, or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.

1. Definitions

"Brass Essence", "We", "Us", "Our" refers to Brass Essence and its proprietorship business.

"You", "Your", "Customer", "User" refers to any individual accessing or purchasing products through our website.

"Products" refers to all products displayed and sold through our website.

"Website" refers to https://brassessence.in.

2. Eligibility

2.1 You must be at least 18 years of age or access this website under the supervision of a parent or legal guardian.

2.2 By placing an order, you confirm that all information provided is accurate and complete.

3. Account Registration

3.1 You are responsible for maintaining the confidentiality of your account credentials.

3.2 Brass Essence reserves the right to suspend or terminate any account involved in fraudulent, abusive, or unlawful activities.

4. Orders & Acceptance

4.1 Placing an order on our website constitutes an offer to purchase.

4.2 An order is considered accepted only after payment confirmation and order confirmation from Brass Essence.

4.3 Brass Essence reserves the right to refuse, cancel, or limit any order due to product availability, pricing errors, suspected fraud, or any other legitimate business reason.

5. Shipping & Delivery

5.1 We endeavor to dispatch all in-stock confirmed orders within 24 hours of order confirmation, excluding Sundays and public holidays.

5.2 Delivery timelines shown on the website are estimates and may vary depending on the courier partner, destination, weather conditions, or other circumstances beyond our control.

5.3 Customers should inspect every product before installation. Transit damage, shortage or an incorrect product supplied must be reported within seven calendar days of delivery with the order number, invoice, clear photographs and an unedited parcel-opening video. Manufacturing defects discovered after delivery may be reported in accordance with the applicable Brass Essence 6-Month Warranty. All claims are subject to verification under our Exchange, Refund and Warranty Policy.

5.4 International shipments may attract customs duties, taxes, or import charges payable by the customer.

6. Pricing & Payments

6.1 All prices displayed are in Indian Rupees (INR) and are inclusive of applicable taxes, unless otherwise specified.

6.2 We accept payment through secure payment gateways available during checkout.

6.3 Brass Essence reserves the right to modify prices without prior notice.

6.4 In the event of an incorrect price due to technical or human error, Brass Essence reserves the right to cancel or modify the order after informing the customer.

7. Exchanges, Returns and Refunds

7.1 Exchanges are not offered for change of mind, project requirements, or an incorrect size, colour, finish or model selected by the customer. Approved damaged, defective or incorrect-product claims are handled as described below.

7.7 If a product arrives damaged or differs from the product ordered, the customer must notify Brass Essence within seven calendar days of delivery and provide the order number, invoice, clear photographs and an unedited parcel-opening video. Manufacturing defects discovered after delivery may be reported during the applicable 6-Month Warranty period and will be assessed in accordance with the Exchange, Refund and Warranty Policy.

7.8 A damaged, defective or incorrect product must not be installed, altered, polished, cleaned or repaired before the claim is reviewed.

7.9 After receiving and inspecting the returned product, Brass Essence may provide a replacement or exchange. If a suitable replacement is unavailable, a refund may be approved.

7.10 Approved refunds will be initiated to the original payment method within 5–7 working days after inspection and approval. The time required for the amount to reflect may vary depending on the customer’s bank, card issuer or payment provider.

7.11 For a verified manufacturing defect, transit-damaged product or incorrect product supplied, Brass Essence will bear reasonable return and replacement transportation charges.

7.12 Brass Essence may decline a claim if the product is used, installed, altered, incomplete, physically damaged after delivery, returned without its original packaging and accessories, or inconsistent with the evidence submitted.

7.14 All exchanges, returns and refunds are governed by the complete Exchange, Refund and Warranty Policy published on the Brass Essence website.

8. Product Descriptions & Variations

8.1 We strive to display accurate product images, colours, finishes, dimensions, and descriptions.

8.2 Slight variations in colour, texture, grain, or finish may occur due to natural materials, handcrafted manufacturing, photography, or screen settings and shall not be considered defects.

9. Intellectual Property

9.1 All website content including logos, product designs, photographs, graphics, videos, text, and trademarks are the exclusive property of Brass Essence unless otherwise stated.

9.2 No content may be copied, reproduced, modified, or distributed without prior written permission.

10. Prohibited Use

You agree not to:

• Use the website for unlawful or fraudulent purposes.
• Attempt to interfere with website security or functionality.
• Copy or misuse our content.
• Misrepresent Brass Essence or its products.
• Resell our products without prior written authorization.

11. 6-Month Warranty

11.1 Eligible Brass Essence products are covered by a 6‑Month Warranty for 6 months from the original invoice date.

11.2 The warranty covers manufacturing defects in the brass component and abnormal peeling, blistering, flaking or failure of the applied finish resulting from a manufacturing defect during normal indoor use.

11.3 The warranty does not guarantee that the original colour, shade, gloss or appearance will remain unchanged. Natural ageing, oxidation, tarnishing, patina, darkening and gradual tonal or colour changes in brass are normal characteristics and are not considered manufacturing defects.

11.4 If a warranty claim is verified, Brass Essence may repair the affected product or component, replace the affected product or component with the same product, provide a comparable replacement where the original product is unavailable, or provide another suitable resolution where repair or replacement is not reasonably available, subject to applicable law.

11.5 A defect affecting one product does not automatically make other products purchased under the same invoice eligible for repair or replacement. Each affected product will be assessed individually.

11.6 The warranty does not cover physical damage, breakage, dents, bending, scratches, chips, impact damage, accidents, misuse, overloading, negligence or improper handling.

11.7 The warranty does not cover damage caused during installation, removal or reinstallation, including incorrect drilling, excessive tightening, unsuitable screws, incorrect fittings, use of power tools or damage caused by an installer, carpenter, contractor or other third party.

11.8 The warranty does not cover damage, discolouration, staining, peeling, blistering or finish deterioration caused by water, wet or damp cloths, excessive moisture, hard water, salt air, construction dust, outdoor exposure, acids, chemicals, detergents, sanitizers, solvents, bleach, metal polish, abrasive cleaners or any other cleaning or polishing agents.

11.9 Brass Essence products must be cleaned only with a clean, soft and dry cloth. Water, wet or damp cloths, cleaners, chemicals, acids, polish or other cleaning agents must not be used.

11.10 Normal wear and tear, minor variations in colour, texture, shade, gloss or finish, and natural variations in marble, wood, leather, ceramic, crystal or other natural or decorative materials are not considered manufacturing defects.

11.11 Products that have been modified, altered, refinished, repaired or used outside their intended application are not covered.

11.12 A valid Brass Essence invoice or other acceptable proof of purchase and claim verification are required for every warranty claim. Brass Essence may request photographs, videos, additional information or physical inspection of the affected product before approving a claim.

11.13 Warranty registration does not by itself confirm that a warranty claim will be approved.

11.14 The 6-Month Warranty runs from the original invoice date. Repair or replacement does not restart or extend the original warranty period except where required by applicable law.

11.15 The warranty is governed by the complete Exchange, Refund and Warranty Policy and the Brass Essence 6-Month Warranty Terms published on the Brass Essence website.

12. Limitation of Liability

12.1 Brass Essence shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our website or products.

12.2 Our maximum liability shall never exceed the amount paid for the specific product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold Brass Essence harmless against any claims, liabilities, damages, losses, costs, or expenses arising from your breach of these Terms or misuse of our website.

14. Privacy

Your use of this website is also governed by our Privacy Policy. By using our website, you consent to the collection, processing, and storage of your information as described therein.

15. Force Majeure

Brass Essence shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, transportation delays, governmental restrictions, war, or supply chain disruptions.

16. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or your use of this website shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka.
